Which Countries are Not Relevant for Visa Approval?
The U.S. Department of State (DOS) has a longstanding policy that does not approve visas for citizens of countries that are not considered to be in compliance with the U.S. Visa Waiver Program (VWP). This policy is codified in Section 212(a)(9) of the Immigration and Nationality Act (INA), which states that the Secretary of State shall determine whether a country is in compliance with the VWP. Section 212(a)(9) was originally designed to prevent uncontrolled migration from certain countries to the United States and has been used to deny visa requests from several countries, including Cuba, Libya, and Vietnam. However, since the implementation of the VWP in 1995, five additional countries (Eritrea, Myanmar, Somalia, Sudan, and Zimbabwe) have been added to Section 212(a)(9).
In 2013, DOS issued a memorandum clarifying which countries are included in the VWP and stating that visa approvals may be granted for nationals of those countries under certain limited circumstances. Under this memo, nationals of Iraq are no longer eligible for U.S. visas because the United States is no longer engaged in hostilities with Iraq. Additionally, visa approvals may be granted to nationals of the following countries under certain limited circumstances: Afghanistan, Albania, Algeria, Bangladesh, Benin, Bolivia (Bolivia has a provisionally approved VWP ), Bosnia and Herzegovina, Central African Republic, Croatia (including the parts of Bosnia and Herzegovina that are not under international supervision ), Cuba, Ecuador, Egypt, Georgia (including Abkhazia and South Ossetia), Guinea (the country has a provisionally approved VWP ), Haiti , India, Indonesia, Iran (Persia or Rep. of) Iraq , Libya Korea Democratic People’s Republic of Korea other than South Korea Laos Lao People’s Democratic Republic Malaysia Malawi Mexico Morroco Mozambique Myanmar Burma Namibia Other countries.
